Article the First — Of Intellectual Property

A game, however many pixels it may wield, remains a made thing, and the maker retains a venerable dominion over its form, its likeness, and its echoes.

Intellectual property within the gaming estate comprises four principal appurtenances: the source code, the audiovisual composition, the marks and liveries, and the expressive narrative. Each is accorded its own species of protection, and each may be licensed severally or in concert. Proprietary Licensing

The classical instrument of commercial gaming houses, the proprietary license retains for the author every stratum of right save the narrow permission of private use. It is the tightly-bound ledger — precise, unyielding, inscribed in full legal counsel. Its virtues are predictability, valuation, and the clean accounting of exclusivity; its costs are friction, fragility, and the ever-present risk of piracy's informal counter-registry.

Open & Permissive

The BSD, MIT, and Apache instruments stand as the permissive bedrock of modern civic making. They bestow the fullest spectrum of right with minimal reservation — typically only a requirement of attribution and the disclaimer of warranty. The author concedes the exclusivity of the proprietary instrument in exchange for the compounding gifts of community contribution and reputational heritage.

Copyleft & Share-Alike

The GPL and its philosophical kin form the copyleft instrument: a license that propagates its own terms through every derivative work. To receive is to be bound; to redistribute is to inherit. It is the cleverest of instruments, for it uses the very mechanism of licensing to guarantee the permanence of its own generosity.

End User License Agreements

The EULA is the most frequently encountered instrument in the gaming estate, yet the least often read. It is the compact a player enters upon first invocation of the work — governing copy, redistribution, modification, and the peculiar terrain of multiplayer conduct. A well-drafted EULA reads as a civil constitution; a poorly-drafted one reads as bureaucratic mist.

Bespoke & Commercial

The bespoke commercial license is the instrument of large-scale transactions — publisher to developer, platform to studio, franchise to adaptation. Its terms are negotiated, territorial, durational, and often encumbered with schedules of royalty, exclusivity, and audit. It is the longest of the licensing instruments, and the most entangled with the laws of commerce proper.
